These GTC apply to sales transactions concluded by the hotelier with non-travel professionals. They apply without restriction or reservation to any purchase of hotel room reservation services and ancillary services offered by the hotel to consumers and non-professional customers on the hotel’s website.
These conditions apply to the exclusion of all other conditions, and in particular those applicable for other marketing channels of the Services.
It is brought to the Customer’s attention that the Hotel concludes partnership agreements with third-party travel providers in order to allow him, using the services offered by these partners on their website, to search, select and book rooms in the Hotel. Any reservation of hotel rooms made under these conditions implies the consultation and full and unreserved acceptance by the Customer of the special conditions of the service provider, the conditions of sale of the reserved rate and these general conditions of sale. The Customer declares to have obtained from the Hotel all the necessary information and available on the website.
These General Terms and Conditions of Sale are accessible at any time on the Hotel’s website and will prevail, if necessary, over any other version or any other contradictory document.
customer acknowledges that he has the capacity to sign a contract, that is, he has the legal majority and that he is neither under guardianship nor under curatorship.
The customer declares:
– Make the reservation of hotel rooms and possibly ancillary services for his personal needs.
The reservation request entails adherence to these conditions of sale and the full and unreserved acceptance of their provisions.
Prices are displayed in euros. VAT is always included. The prices indicated include only the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added, when invoicing, the additional services or extras provided by the hotelier during the stay.
The rates are indicated before and at the time of the reservation made by the Customer. They are per room for the number of people and the date selected.
Force majeure means any event external to the parties of a character that is both unforeseeable and insurmountable that prevents either the customer or the hotelier from fulfilling all or part of the obligations provided for in the contract. This is particularly the case in the event of a strike, riot insurrection, prohibitions issued by government or public authorities. It is expressly agreed that the event of force majeure suspends for the parties the performance of their reciprocal obligations and that each party thus bears the burden of the resulting costs.
Any complaint must be made to the hotelier within 8 days from the date of end of the stay. Any dispute, claim or dispute relating to the terms of booking the hotel room is subject to French law.
The Customer will take possession of the room from 4pm and is required to release it at 10.30am.
Pets are not allowed in the property.
The right of access of outsiders is strictly prohibited, unless expressly authorized by the hotel management.
The hotel reserves the right to cancel or refuse any reservation of a customer with whom there is a dispute relating to a previous reservation.
Each reservation is nominative and cannot be transferred to a third party.
Cancellation of a reservation at the flexible rate:
- For reservations from 01 January to 30 June and from 01 October to 31 December; if the reservation is cancelled more than 03 days before the date of arrival, it is fully refundable, from d+3 until the start date of the stay, the entire stay is due. As well as in case of no-show (no show), the entire stay is due.
- For reservations from 01 July to 30 September; if the reservation is cancelled more than 20 days before the date of the stay, it is fully refundable. If the reservation is cancelled between the date of the stay and 20 days before, the entire stay is due. In case of no show, the entire stay is due.
As the hotel is a completely non-smoking area (except on the terraces and outdoor area), the customer will be held responsible for direct and/or indirect, consequential damages resulting from the act of smoking in the hotel. He will therefore be liable for the full amount of the costs of cleaning and restoration to the original condition of the damaged element or space.
We ask our guests to respect the premises, the layout, the decoration, the furniture of your room as well as the common areas.
The Customer accepts and undertakes to use the room in good faith. Also any behavior contrary to morality and public order will lead the hotel to ask the Customer to leave the establishment without any compensation and / or without any refund if a payment has already been made. In the event that no payment has yet been made, the customer will have to pay the price of the nights consumed before leaving the establishment.
The Customer will be held responsible for all direct and/or indirect damage, of which he is the author, found in the reserved room or that he may cause within the hotel. Consequently, he undertakes to compensate the hotel up to the amount of the said damages, without prejudice to any damages that may be due, procedural and legal costs incurred by the hotel.
An inventory will be established before and after the stay, in case of damage to equipment or theft the cost of repairs or / and location will be borne by the customer.
Given the constraints of verification of the room by the hotel staff, the finding of theft or damage can be done within 4 hours after the departure of the customer.
Kitchens, utensils, household appliances, cutlery, plates, glasses, are given clean and must be made clean, failing which a cleaning fee of 50 euros will be applied.
Unless expressly provided otherwise, the room will be made available to the customer on the day of arrival at 4 pm and he will leave the room on the day of departure at 10.30 am. Otherwise, an additional night will be charged to the customer.
The price, terms and conditions of the reservation aim to sell hotel rooms according to their main purpose: accommodation. The hotel reserves the right to modify or cancel the reservation(s), as well as the rates and conditions if the rooms are used for other purposes; such as parties, dinners, meetings, photo or video shoots, film shoots or written or filmed interviews etc….(non-exhaustive list), without the prior written permission of the management.
The Customer will have a period of 08 days from his date of departure from the Hotel to issue, in writing, reservations or complaints concerning the provision of the Services, with all supporting documents, to the Hotel. No claim can be accepted in case of non-compliance with formalities and deadlines by the customer.
Right of withdrawal:
In accordance with Article L 221-28 of the Consumer Code, the Customer does not have the right of withdrawal provided for in Article L 221-18 of the Consumer Code, given the nature of the services provided.
The contract is therefore definitively concluded as soon as the reservation is made by the Customer according to the terms specified in these General Terms and Conditions of Sale.
These general conditions of sale and the operations resulting from them are governed by and subject to French law.
These GTC are written in French, in the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
The court of BASTIA has sole jurisdiction.
